Please read these Terms & Conditions ("Terms") carefully before using the YumYummy Telegram bot service (the "Service", "@yum_yummybot"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

Subscription payments are processed via Telegram Stars (XTR) inside the Telegram app or by bank card (including Apple Pay and Google Pay) through Paddle.com, our merchant of record.

2. Description of Service

YumYummy is an AI-powered calorie and nutrition tracking assistant delivered via Telegram bot (@yum_yummybot). The Service allows users to:

Log meals by text, voice message, or barcode photo;
Receive AI-estimated nutritional information (calories, protein, fat, carbohydrates);
Track daily and weekly nutritional progress against personal goals;
Receive food recommendations based on remaining nutritional targets.

The Service is a digital, subscription-based product. No physical goods are provided.

3. Eligibility

You must be at least 18 years of age to use the Service. By using the Service you represent and warrant that you meet this requirement. If you are under 18, please do not use the Service.

4. Account & Access

Access to the Service is linked to your Telegram account. You are responsible for maintaining the security of your Telegram account and for all activity that occurs under your Telegram user ID. We are not responsible for any loss or damage arising from unauthorised access to your Telegram account.

5. Subscription & Billing

5.1 Subscription Plans

The Service is offered on a subscription basis. Available subscription plans, billing intervals, and pricing are displayed on the checkout page at the time of purchase.

5.2 Automatic Renewal

Subscriptions renew automatically at the end of each billing period unless cancelled before the renewal date. By subscribing you authorise the applicable payment provider (Telegram or Paddle) to charge your chosen payment method on a recurring basis for the applicable subscription fee.

5.3 Price Changes

We may change subscription prices. We will notify you at least 30 days before any price change takes effect. If you do not cancel before the change takes effect, you will be deemed to have accepted the new price.

5.4 Cancellation

You may cancel your subscription at any time. For Telegram Stars subscriptions, cancel via Telegram Settings → My Stars → Subscriptions. For card subscriptions via Paddle, cancel through the subscription management link provided in the bot's Profile section. Cancellation takes effect at the end of the current billing period; you will retain access to the Service until that date. Cancellation does not entitle you to a refund for the current billing period unless you are eligible under our Refund Policy.

5.5 Payment Processing

Payments are processed via one of the following methods:

Telegram Stars (XTR) — processed within the Telegram app using Telegram's built-in payment infrastructure.
Bank card / Apple Pay / Google Pay — processed by Paddle.com Market Limited ("Paddle"), which acts as our merchant of record. Paddle handles all card transactions, invoicing, sales tax / VAT, and refund processing for card payments. See Paddle's Privacy Policy and Paddle's Terms for details.

We do not store or have access to your payment card details under either method.

6. Free Trial

New users receive a free trial to explore the Service. The trial duration is displayed at the time you sign up. During the trial, a fair-use AI usage allowance of US $2.00 equivalent in AI processing costs applies. If the trial usage allowance is reached before the trial period ends, you will be prompted to subscribe to continue using the Service. At the end of the trial, your account will require a paid subscription to continue.

7. Fair Use & Usage Limits

7.1 AI Usage Allowance

The Service relies on third-party AI models and real-time web search to provide nutritional data. To ensure service quality and availability for all users, each plan includes a generous AI usage allowance per billing period:

Free trial: US $2.00 equivalent in AI processing costs per trial period;
Monthly subscription: US $10.00 equivalent in AI processing costs per 30-day billing cycle.

These allowances are designed to comfortably cover normal daily usage. The vast majority of users will never reach these limits under typical use.

7.2 What Counts Toward the Allowance

The AI usage allowance covers the cost of AI model processing (text generation, image analysis) and web search queries performed by the Service on your behalf when logging meals, looking up nutrition data, or receiving food recommendations.

7.3 What Happens When the Limit Is Reached

If you reach your usage allowance before the end of your billing period, the Service will notify you in-app and temporarily pause AI-powered features until your next billing cycle begins. You may contact support at any time for assistance. Usage counters reset automatically at the start of each new billing period (or upon subscription renewal).

7.4 Changes to Allowances

We reserve the right to adjust usage allowances. We will notify you of any material changes at least 14 days in advance. If you do not agree with the updated allowances, you may cancel your subscription before the change takes effect.

8. Refunds

Refund requests are governed by our Refund Policy. We offer a 14-day money-back guarantee applicable to your first subscription payment only. If you have already received a refund on a previous subscription, you are not eligible for a further refund. See our Refund Policy for full conditions.

9. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose or in violation of any applicable law or regulation;
Attempt to reverse-engineer, copy, or redistribute any part of the Service or its underlying AI models;
Use automated scripts or bots to send messages to the bot at a rate that causes disruption to other users or our infrastructure;
Misrepresent your identity or provide false information during onboarding;
Share your subscription access with third parties or resell the Service.

We reserve the right to suspend or terminate your access without refund if you violate this section.

10. Health & Medical Disclaimer

The nutritional information provided by the Service is generated by artificial intelligence and is for informational purposes only. It is not medical advice, dietary therapy, or a substitute for consultation with a qualified healthcare or nutrition professional.

Nutritional estimates may be inaccurate, particularly for home-cooked meals, restaurant dishes, or unusual ingredients. You should not rely solely on the Service's estimates for medical or dietary decisions, especially if you have a medical condition such as diabetes, an eating disorder, or any other health issue requiring precise nutritional management.

Always seek the advice of a qualified health professional before making significant changes to your diet.

11. Intellectual Property

All content, software, and technology underlying the Service are owned by or licensed to YumYummy. Your subscription grants you a limited, non-exclusive, non-transferable, revocable licence to use the Service for your own personal, non-commercial purposes only. No rights are transferred to you beyond those expressly stated in these Terms.

12. User Content

You retain ownership of the text, photos, and voice messages you send to the bot ("User Content"). By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free licence to process and store that content solely for the purpose of providing the Service to you. We will not use your User Content to train AI models without your explicit consent.

13. Service Availability

We aim to provide a reliable service, but we do not guarantee that the Service will be uninterrupted, error-free, or available at all times. We may suspend the Service temporarily for maintenance, updates, or events beyond our reasonable control.

14. Limitation of Liability

To the maximum extent permitted by applicable law:

The Service is provided "as is" and "as available" without warranties of any kind, express or implied;
We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of (or inability to use) the Service;
Our total aggregate liability to you in connection with the Service shall not exceed the total amount paid by you to us in the 12 months preceding the claim.

15. Indemnification

You agree to indemnify, defend, and hold harmless YumYummy and its affiliates, officers, agents, and employees from any claim, demand, or damages (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

16. Termination

Either party may terminate the subscription at any time as set out in Section 5.4. We may immediately suspend or terminate your access if you breach these Terms, with or without prior notice. Upon termination, your right to access the Service ceases. Sections 10, 11, 14, 16, and 17 survive termination.

17. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the United Arab Emirates. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of the UAE, except where otherwise required by mandatory applicable law.

18. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by sending a message through the Service or by email. Continued use of the Service after the effective date of the updated Terms constitutes acceptance of the new Terms.
